Markovits, Stock & DeMarco Files Data Breach Class Action Lawsuit Against Kroger

On March 3, 2021, Markovits, Stock & DeMarco, LLC and Goldenberg Schneider, LPA, on behalf of Plaintiff James Jones, filed a class action lawsuit in the Southern District of Ohio against The Kroger Company for allegedly failing to properly safeguard its customers’ sensitive medical and personal information, as well as its employees’ sensitive personal information.

Kroger began notifying victims of the breach via letter on February 19, 2021. Unfortunately, Kroger’s data breach included the sensitive HR files of Kroger’s employees, as well as the sensitive personal identifying and medical information of certain of its pharmacy and Little Clinic customers.

Such information purportedly includes full names, residential addresses, dates of birth, phone numbers, social security numbers, insurance information, prescription information (such as prescribing doctor, medication names and dates), medical history, medical diagnoses, medical treatment information, medical testing data, and/or clinical history.
